Clawback is a term used in legal discovery to allow the defense to have returned previously turned over documents.
In the legal process there is a discovery phase where the defense is required to turn over relevant information to the plaintiff. As part of the process, confidential and privileged information may be withheld and noted as part of the turn over of documents. If a document initially turned over, then is later discovered to be privileged the defense will request the document returned and this document is commonly referred to as a clawback.
